The Leopard ("we", "us", "our") respects your privacy and is committed to handling your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This policy explains what personal information we collect, how we use and protect it, and the choices available to you. It applies to the website theleopard.com.au (the "Site") and to any related services, communications, or transactions with us.

1. Who we are

2. The personal information we collect

We only collect personal information that is reasonably necessary for what we do. Depending on how you interact with us, this may include:

  • Payment information - payment is processed by our third-party payment provider (currently Shopify Payments). We do not store full credit or debit card numbers on our systems. We may retain a transaction reference, the last four digits of the card, and the cardholder's name.
  • Account information - if you create an account, your login credentials and any preferences you save.
  • Communications - the content of emails, messages, or correspondence you send us, including enquiries, feedback, and reviews.
  • Marketing preferences - whether you have subscribed to our newsletter or opted in to other communications.
  • Technical and usage information - your IP address, device and browser type, referring page, pages viewed on the Site, and the date and time of access. This is collected automatically through cookies and similar technologies (see Section 8).

We do not knowingly collect sensitive information (as that term is defined in the Privacy Act). If you choose to share sensitive information with us - for example, in correspondence — we will only use it for the purpose for which you provided it.

3. How we collect personal information

We collect personal information:

  • directly from you, when you place an order, create an account, contact us, or subscribe to our newsletter;
  • automatically, when you use the Site (through cookies and analytics tools); and
  • occasionally from third parties - for example, our payment processor, shipping partners, or platforms you use to interact with us (such as social media).

Where it is lawful and reasonable to do so, you may interact with us anonymously or under a pseudonym. However, we may not be able to fulfil orders or respond to enquiries without certain information.

4. Why we collect and use your information

We use personal information to:

  • process and deliver your orders, including communicating with you about delivery status, returns, and exchanges;
  • manage your account and any reward, loyalty, or membership programs;
  • respond to your enquiries, requests, or feedback;

5. Disclosure to third parties

  • Logistics and delivery partners - to ship and deliver your orders.
  • Technology providers - including our e-commerce platform, hosting provider, email service provider, customer support tools, and analytics providers.
  • Professional advisers - such as accountants, auditors, and lawyers, where reasonably required.
  • Suppliers - such as suppliers of products we sell.
  • Government, regulatory, or law enforcement bodies - where we are required or permitted by law to do so.

We require our service providers to handle personal information in line with this policy and applicable Australian privacy laws.

We do not sell your personal information.

Relationship with Shopify

Many of our services are hosted by Shopify, which collects and processes personal information about your access to and use of the services in order to provide and improve the services for you. Information you submit will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. 6. Overseas disclosure

Some of the third parties referred to in Section 5 are located outside Australia, or store data on servers located overseas. Based on our current providers, your personal information may be disclosed to, or stored in, the following countries: Italy.

Where we disclose personal information overseas, we take reasonable steps to ensure the recipient handles it in a manner consistent with the Australian Privacy Principles, including through contractual protections.

7. Direct marketing

If you have subscribed to our newsletter or otherwise consented, we may send you marketing communications about new arrivals, makers, stories, and events. These communications are sent in accordance with the Spam Act 2003 (Cth).

You can unsubscribe at any time by clicking the unsubscribe link in any marketing email, or by contacting us at info@theleopard.com.au. We will action your request promptly. You will continue to receive transactional communications (such as order confirmations) where these are necessary to provide the service you have requested.

8. Cookies and analytics

The Site uses cookies and similar technologies to remember your preferences, keep you signed in, secure the Site, and understand how it is used.

You can control cookies through your browser settings. Disabling cookies may affect how the Site functions, including your ability to complete a purchase.

If we use a cookie banner or consent management tool, your preferences will also be respected through that tool.

9. How we protect your information

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, and disclosure. These steps include:

  • using reputable, secure platforms for payments, hosting, and customer data;
  • encrypting data in transit (HTTPS) across the Site;
  • restricting staff access to personal information on a need-to-know basis;

No system is perfectly secure. While we work to protect your information, we cannot guarantee absolute security.

10. How long we keep your information

Order, transaction, and tax records are typically retained for at least seven years to comply with Australian taxation and consumer law requirements. When personal information is no longer needed, we take reasonable steps to delete it or de-identify it.

You have the right to ask us:

  • to provide you with a copy of that information; and
  • to correct it if it is inaccurate, out of date, incomplete, irrelevant, or misleading.

We may need to verify your identity before processing your request. There is no fee to make a request, although a reasonable cost-recovery charge may apply for providing a copy of information in some cases. We will tell you in advance if any charge applies.

If we cannot give effect to your request, we will explain why in writing.

12. Notifiable data breaches

We comply with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act 1988 (Cth) as required. If we become aware of a data breach that is likely to result in serious harm to any individual whose personal information is involved, if required by law we will notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as required.

13. Complaints

If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please contact us first at info@theleopard.com.au so we can try to resolve the matter. We will acknowledge your complaint within a reasonable period and aim to provide a response within 30 days.

14. Children's privacy

The Site is not directed at children under the age of 16, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

15. Changes to this policy

We may update this policy from time to time. Where the changes are significant, we will take reasonable steps to bring them to your attention - for example, by email or by a notice on the Site.
