1. About these terms

These terms and conditions (“Terms”) govern every purchase made through theleopard.com.au (the “Site”). By placing an order you agree to these Terms. Please read them carefully.

We may update these Terms from time to time. The version in force when you place your order applies to that order.

2. Who we are

The Leopard Tour Pty Ltd (ABN 59 688 406 546) operates The Leopard. We are a homewares retailer based in Moss Vale NSW, Australia, selling exclusively within Australia.

3. Orders and contract formation

Placing an order

An order placed through the Site is an offer by you to purchase the relevant goods. No contract is formed until we send you an order confirmation by email. If we are unable to fulfil your order for any reason - because an item is out of stock, because a pricing error occurred, or for any other reason - we will notify you promptly and provide a full refund if payment has already been taken.

Accuracy of information

We make every effort to describe and photograph our products accurately. Because many of our goods are handmade, there will naturally be variation between pieces - in colour, texture, dimension, and finish. This is a feature of the work, not a defect. Where variation is significant, we say so in the product description.

Cancellations

Once an order has been dispatched, it cannot be cancelled. If your order has not yet been dispatched, please contact us as soon as possible at info@theleopard.com.au and we will do our best to help.

4. Pricing and payment

All prices are in Australian dollars (AUD) and inclusive of GST where applicable. Prices are subject to change without notice, but changes will not affect orders already confirmed.

Payment is taken at the time of order. Payment is processed securely by Shopify. We do not store your full card details.

If a pricing error has caused an incorrect amount to be charged, we will contact you before processing the order. You will have the choice to proceed at the correct price or receive a full refund.

5. Shipping and delivery

Where we ship

We currently ship within Australia only.

Delivery times

If an estimated delivery times is provided, it is a guide only. We cannot guarantee delivery by a specific date. Delivery times may be longer for remote areas or during peak periods.

Some of our products are dispatched from makers based in Europe and Asia, and you will be made aware of this before placing your order. We will notify you when your order has been dispatched and provide tracking information where available.

Delivery address

You are responsible for providing a complete and accurate delivery address. We cannot accept liability for orders delivered to an incorrect or incomplete address provided by you.

Risk and title

Risk in the goods passes to you upon delivery to the address provided. Title passes upon receipt of full payment.

Failed delivery

If a delivery attempt is unsuccessful and the goods are returned to us, we will contact you to arrange re-delivery. Additional postage charges may apply.

6. Returns and refunds

Your rights under Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Change of mind

We do not offer returns or exchanges for change of mind. Please choose carefully, and contact us before placing an order if you have any questions about a product.

Faulty, damaged, or incorrectly described goods

If your order arrives faulty, damaged in transit, or materially different from how it was described on the Site, please contact us at info@theleopard.com.au within 14 days of receiving your order. Please include your order number, a description of the issue, and photographs where possible.

We will assess the issue and, where your claim is valid, offer you a repair, replacement, or refund, in accordance with the Australian Consumer Law. Where a refund is provided, it will be to your original payment method.

Handmade variation

Natural variation in colour, texture, dimension, or finish that is characteristic of handmade goods does not constitute a fault or misrepresentation. We take care in describing such variation in our product listings.

Return shipping

Where a return is required, we will provide instructions. Return shipping costs for faulty or incorrectly described goods are at our expense. We do not cover return shipping costs for any other reason.

7. Intellectual property

All content on the Site - including text, photography, illustrations, product descriptions, and design - is owned by or licensed to The Leopard and is protected by Australian and international copyright and intellectual property laws.

You may view and print content from the Site for your own personal, non-commercial use. You may not reproduce, republish, distribute, adapt, or commercially exploit any content without our prior written permission.

Product images remain the property of The Leopard or the relevant maker. Use of product images without permission is not permitted.

8. Limitation of liability

To the extent permitted by law, The Leopard’s liability to you in connection with any order is limited to the purchase price paid for the relevant goods. We are not liable for any indirect, consequential, incidental, or special loss or damage.

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, that cannot be excluded under the Australian Consumer Law or any other applicable law.

We take reasonable steps to ensure the Site operates without error or interruption, but we do not warrant that it will always be available or free from technical issues.

9. Governing law

These Terms are governed by the laws of NSW, Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of NSW, Australia.
